Definitions
In these terms:
| "we", "our", "us", "Love Web Design" | Acia Software Consultant Ltd t/a Love Web Design |
| "you", "your","the client" | meaning the person, firm, or company for whom the service relates to. |
| "in writing", "written" | meaning signed letter(s), e-mail(s). |
| "the Project" | Work to be undertaken by Love Web Design for the Client. |
Introduction
By instructing us to design, produce, maintain and/or arrange to display your web site you will agree to the Terms & Conditions that will govern our relationship with you and by placing your order it is understood that you have accepted these Terms of Business.
The design and functionality will be agreed prior to commencement of the building of the web site. Once design and/or build has commenced any changes to the Initial Brief may incur additional charges, further defined in the Section entitled Corrections and Modifications, and may effect the previously agreed schedule to complete the work.
Nothing contained within these Terms & Conditions may be varied, replaced or superseded unless any such alterations are agreed and confirmed by us in writing prior to such change.
Payment
Love Web Design is a trading name of Acia Software Consultant Ltd. Acia Software Consultant Ltd is a VAT registered company and VAT will be applied to all transactions at the time of billing at the current rate.
All quotations are valid for a period of 30 days. We reserve the right to amend the quotation or to decline work after this period.
Work under the value of £50.00 is to be paid in full prior to work commencing, unless otherwise stated.
Unless otherwise agreed a non-refundable deposit of 30% of the total cost quoted is required prior to work commencing.
The balance of which must be made once the website is approved by the client. However, delivery will not occur until full payment has been received.
All payments must be paid within 30 days from date of invoice.
Payment for all services is due by cheque or bank transfer, details for bank transfer are available on request. All Cheques should be made payable to Acia Software Consultant Ltd and sent to Acia Software Consultant Ltd, 37 Watermill Lane, Bexhill-on-Sea, East Sussex TN39 5EB.
Content & Content Checking
It is the sole responsibility of the Client to ensure that all web content complies with all legal, copyright and current legislation(s).
It is the sole responsibility of the client to make sure all content is correct before final approval and delivery. Final approval and client signature will be sought to verify this.
All text and images provided by the client for their website must be copyright approved prior to delivery. Love Web Design takes no responsibility for copyright of any client-supplied images.
All content supplied by the Client should be delivered in one package, containing images, text, captions etc. This package must contain clear instructions on where the content is to go.
We will not be held responsible for any loss or damage, whether direct or inconsequential arising from errors or omissions in the contents of your website.
Corrections, Modifications & Alterations
If Love Web Design feels that any item requested by the client does not fit within the initial brief, the client will be notified immediately. The item will then either be quoted separately, or charged as an extra at a rate of £20 per hour or part thereof.
It is the client's sole responsibility to ensure that all web content is correct and that they are completely satisfied with the design prior to Final Approval. Once a site has been approved and signed-off, all additional corrections and modifications to the site will be charged as extras at a rate of £20 per hour or part thereof.
Domain Names
Domain names are subject to availability.
Domain Names will be purchased using our preferred supplier. Domain Names are supplied at cost.
Domains names such as .CO.UK, .ORG.UK, .ME.UK, .LTD.UK AND .PLC.UK are supplied at a cost of £10 per 2 years including VAT whereas .COM, .ORG, .BIZ, .INFO and .NAME are supplied at a cost of £10 per 1 year including VAT.
Domain Names will be registered in the Client's name and for the Client's exclusive use with the applicable Registration Authority.

Web Hosting
Clients should note that Love Web Design use third party hosting services, and reserves the right to change the hosting service at will to provide the most reliable and cost effective service possible.
You are advised by us that the hosting service is deemed to be suitable for small business usage. It is not suitable for any site which uses bandwidth through use of multimedia, pay-per-click, mass market attraction or has heavy traffic.
Our hosting facilities are currently supplied by our Domain Registration Supplier as part of the Domain Registration package. This is a FREE facility that we do not charge for, merely pass on to you.
You will be bound by their Terms and Conditions, once your domain name is registered and hosting package is secured. Our Suppliers' Terms of Services are available on request.
We shall not be held responsible for loss of earnings, or other financial liabilities arising from circumstances beyond our control.
We reserve the right to impose additional fees for extra time spent working with a hosting company not recommended or approved by us.
Client Site Location
We will build and host a working website for the client. This will be hosted by Love Web Design for the duration of the Project.
This site will be used by the client to check design, functionality and content. This site will remain at this location until the client has approved the website whereupon the site shall be removed from this location and prepared for delivery to its final location.
It shall not be delivered until payment has been received in full.
Accessibility & Compatibility
Love Web Design makes all efforts to ensure accessibility, usability and browser compatibility. Unfortunately, with the best efforts in mind this is not always a guarantee.
Unless otherwise stated and/or agreed with the Client websites produced by Love Web Design are tested to the following standards:

| Browsers: | Latest Versions of Internet Explorer, Firefox, Safari and Opera. |
| Operating Systems: | Microsoft Windows, Linux & Mac OSX. |
| Accessibility: | W3C validation & Web Content Accessibility Guidelines. |
Search Engine Submission & Optimisation
Love Web Design takes care to add basic meta data (title, keywords, description) into each document and will perform basic search engine submissions of a new site.
However Love Web Design are not experts in search engine submission and search engine optimisation and therefore takes no responsibility for search engine results on the work that we undertake.
It is the responsibility of the client to submit their site to search engines and directories or to employ a company with this expertise.
Ownership & Copyright
The website will remain the property of Love Web Design until Final Approval and Full payment have been received.
After which, the website and all contents not supplied by the client will become the property of the client unless otherwise indicated in the Documentation Pack presented to the client on the completion of the Project.
NOTE: Where stock images are purchased and supplied by Love Web Design, their use and any limitations will be clearly indicated in the Documentation Pack presented to the Client on completion of the Project.
Design Credit
A discrete link to the Love Web Design website will appear at the bottom of each page on the website, unless we are requested not to do so by the client.
A direct link will be placed on Love Web Design's portfolio page, unless otherwise stated by the client.
Cancellation
We reserve the right to cancel the contract at any time without compensation or explanation, returning all materials and expenses already paid to Love Web Design, except for those directly incurred by Love Web Design i.e. for the registration of a website name for the client.
If at any point during the contract the client wishes to cancel they may do so in writing but will be invoiced an amount deemed to be appropriate for the work already carried out by Love Web Design.
